GoTasty LLC ("GoTasty," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you use our website, mobile applications, and services (collectively, the "Services"), including the GoTasty application installed through the Clover App Market.

Please read this Privacy Policy carefully. By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy.

Our Role

When a merchant ("Merchant") uses the Services to operate their branded ordering, loyalty, or marketing experience, GoTasty processes personal information of the Merchant's customers solely on behalf of and as a Service Provider to the Merchant, and not for GoTasty's own independent commercial purposes. The Merchant is the business responsible for its customer relationships and for its own compliance with applicable privacy laws.

For Merchants themselves (for example, the restaurant owner, their staff, and their billing contacts), GoTasty collects and uses Merchant-level personal information as described in this Privacy Policy to provide the Services to the Merchant.

Information We Collect

Information You Provide to Us

We collect information you provide directly to us, including:

• Account Information: When you create an account, we collect your name, email address, phone number, business name, and password.
• Business Information: Information about your restaurant, café, or food-service business, including location, menu items, pricing, and operating hours.
• Payment Information: When you subscribe to our Services or receive payouts from customer orders, payment card details, bank account information, and transaction history are collected. Payment processing is handled by our third-party payment processor, Stripe, Inc.
• Communications: When you contact us, we collect the content of your messages and any attachments.

Information We Collect Automatically

When you access or use our Services, we automatically collect certain information, including:

• Device Information: Device type, operating system, unique device identifiers, and mobile network information.
• Log Information: Access times, pages viewed, IP address, and the page you visited before navigating to our Services.
• Location Information: With your consent, we may collect precise location data from your device for geofencing features.
• Usage Information: Information about how you use our Services, including features accessed and actions taken.

Information from Third Parties

We may receive information about you from third parties, including:

• Clover POS: When a Merchant connects its Clover point-of-sale system to the Services, we receive menu, tax, modifier, order type, order, and print-event data from Clover on behalf of the Merchant.
• Payment processors: For transaction verification and payout information.
• Analytics providers: For usage data and service improvement.

How We Use Your Information

We use the information we collect to:

• Provide, maintain, and improve our Services
• Process orders, payments, payouts, and related transactions
• Send promotional communications to Merchants (you may opt out at any time); consumer-facing marketing communications are sent on behalf of, and at the direction of, the Merchant
• Respond to your comments, questions, and customer-service requests
• Monitor and analyze trends, usage, and activities in connection with our Services
• Detect, investigate, and prevent fraudulent transactions and other illegal activities
• Personalize and improve your experience with our Services
• Comply with legal obligations and enforce our terms and policies

Consistent with our role as a Service Provider, GoTasty limits personal-information collection, use, retention, and disclosure to activities reasonably necessary and proportionate to provide the Services, or for another compatible operational purpose.

How We Share Your Information

We may share your information in the following circumstances:

• With Merchants: Consumer personal information collected through a Merchant's storefront is made available to that Merchant, who is the business responsible for that consumer relationship.
• With Service Providers: We share information with third-party vendors, consultants, and service providers who perform services on our behalf, such as payment processing (Stripe), point-of-sale integration (Clover), delivery fulfillment (Uber Direct), SMS and voice (Twilio), cloud storage, email delivery, analytics, and customer service.
• With Your Consent: We may share information with third parties when you give us consent to do so.
• For Legal Reasons: We may share information if we believe disclosure is required by law, regulation, or legal process.
• Business Transfers: In connection with any merger, sale of company assets, financing, or acquisition of all or a portion of our business.
• Aggregated or De-identified Data: We may share aggregated or de-identified information that cannot reasonably be used to identify you.

GoTasty does not "sell" personal information (as that term is defined under the California Consumer Privacy Act) and does not share personal information for cross-context behavioral advertising.

Your Rights and Choices

Account Information

You may update, correct, or delete your account information at any time by logging into your account settings. If you wish to delete your account, please contact us at info@gotastyapp.com.

Marketing Communications

You may opt out of receiving promotional emails from GoTasty by following the unsubscribe instructions in those messages. If you opt out, we may still send you non-promotional emails, such as those about your account or our ongoing business relations. Consumer marketing communications sent on behalf of a Merchant can be managed by contacting that Merchant directly.

Push Notifications

With your consent, we may send push notifications to your mobile device. You can disable push notifications at any time through your device settings.

Location Information

You can prevent the collection of precise location information by disabling location services on your mobile device.

Consumer Requests Directed to Merchants

If you are a consumer who ordered from a Merchant's GoTasty-powered storefront and wish to exercise a right under Privacy Laws (for example, access or deletion of your personal information), we will redirect you to make your request directly to the Merchant, who is the business responsible for that consumer relationship. GoTasty will reasonably cooperate with and assist the Merchant in responding to such requests.

California Residents

If you are a California resident, you have additional rights under the California Consumer Privacy Act ("CCPA"), including the right to:

• Know what personal information we collect, use, disclose, and retain about you, and the categories of sources and third parties involved
• Request deletion of your personal information
• Request correction of inaccurate personal information
• Opt out of the sale or sharing of personal information (GoTasty does not sell or share personal information as those terms are defined under the CCPA)
• Limit the use of sensitive personal information (GoTasty does not use sensitive personal information for purposes other than those permitted by the CCPA)
• Non-discrimination for exercising your privacy rights

Data Security

We implement appropriate technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

Data Retention

We retain your personal information for as long as necessary to fulfill the purposes for which it was collected, including to satisfy any legal, accounting, or reporting requirements. The retention period may vary depending on the context of the processing and our legal obligations.

International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence. These countries may have data protection laws that are different from the laws of your country. We take appropriate safeguards to ensure that your personal information remains protected.

Children's Privacy
